WEBMASTER Agreement

There are a few important limitations to the use of WEBTIME TOOLS. Please read these articles carefully before accessing or using the INTERNET TOOLS services offered.
To use the services you must agree to the WEBTIME TOOLS AGREEMENT. By accessing or using this web site or services, you agree to be bound by this agreement. If you do not agree to these articles, you may not use the service.

Service. This service is provided to WEBMASTERS who agree to abide by the WEBTIME TOOLS AGREEMENT. The TOOLS may be used for business (commercial) sites or personal sites. Any WEBMASTER who breaks this agreement may have their account canceled at any time, at WEBTIME TOOLS sole discretion. The WEBMASTER may be permanently banned from using the WEBTIME INTERNET TOOLS website. You agree to indemnify and hold harmless WEBTIME INTERNET TOOLS for any loss, liability, and damage arising from or in connection with the contents or service of any WEBTIME INTERNET TOOLS web service

Right to Refuse Service. WEBTIME INTERNET TOOLS reserves the right to refuse service to anyone at any time, for any reason and without prior notice.

Prohibited Material. This includes but is not limited to the following:
I. No profanity, or harassment
II. No hate or racist propaganda
III. No illegal activity under any law
IV. No nudity or pornographic material
V. No material that violates or infringes
VI. Any material which WEBTIME INTERNET TOOLS deems inappropriate, at its sole discretion

If your use or web site contains any of the above material, you may not use WEBTIME INTERNET TOOLS. If you violate the WEBMASTER AGREEMENT, and place prohibited material on a WEBTIME INTERNET TOOLS web page anyway, your account will be subject to deletion without notice and possible banning from the service. If you think material you use may be questionable, email support@webtimetools.com for a review.

 

Modifications. WEBTIME INTERNET TOOLS reserves the right to modify or discontinue the service, or any portion of the service, with or without notice to you, and shall not be liable to you or to any third party for any consequences arising from such modification or discontinuation.

Your Password and Account Information. You are entirely responsible for maintaining the confidentiality of your password and account. You are responsible for the use of your account and all activity under your account, whether used under any name or by any person, and for ensuring FULL compliance with this Agreement by all users of your account. You agree to indemnify, defend, and hold harmless WEBTIME INTERNET TOOLS for any liability or expense arising from such use or misuse of your password and account

Cancellation. Either you or WEBTIME INTERNET TOOLS may cancel your use and access to the service at any time for any reason or for no reason. You may cancel your membership by sending a cancellation notice containing your email address, WEBMASTER name and password to support@webtimetools.com. WEBTIME INTERNET TOOLS may immediately restrict, suspend or cancel your membership in the service at any time thereafter without prior notice. Upon canceling membership you the WEBMASTER agree to remove all references and links to WEBTIME INTERNET TOOLS from your web site and all web pages.

Disclaimer. You agree and understand that you are using the service and this web site at your own risk. The service and this web site are provided on an "AS IS" and "AS AVAILABLE" basis. WEBTIME INTERNET TOOLS makes no warranties with respect to the service, either express or implied, and WEBTIME INTERNET TOOLS hereby disclaims to the fullest amount allowed by law, any warranties of satisfactory quality, quiet enjoyment, merchantability, fitness for a particular purpose or non-infringement.
You acknowledge and agree:
I. That the service may contain bugs, defects and errors.
II. That the service may be unavailable or inaccessible to you for substantial periods of time.
III. That data may be lost or corrupted, including your entire web site and all information it contains.
IV. You agree to back-up onto your own system, if possible, any data or information you do not want to lose. No oral advice or written information given by WEBTIME INTERNET TOOLS, its employees, affiliates, or the like, will create a warranty; nor may you rely on any such information or advice.

LIMITATION OF LIABILITY. Under no circumstances, including negligence, will WEBTIME INTERNET TOOLS, or its affiliates be liable for any direct, indirect, incidental, reliance, special, exemplary or consequential damages that result from the use of or inability to use the service or this web site.
This includes but is not limited to reliance on any information obtained via the service, or that results from mistakes, omissions, interruptions, deletion of files or e-mails, loss of or damage to data, errors, defects, viruses, delays in operation, or in transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to WEBTIME INTERNET TOOLS records, programs or services, lost profits or goodwill.
You hereby acknowledge that the foregoing limitation applies to you regardless the theory of liability (including breach of contract, negligence and strict liability) that this provision will apply whether or not WEBTIME INTERNET TOOLS is given notice of the possibility of such damages, and that this provision will apply to all content, merchandise or services available through the service, or from WEBTIME INTERNET TOOLS or its affiliates. In addition, WEBTIME INTERNET TOOLS disclaims all liability regardless of the form of action, for the acts or omissions of other users (including unauthorized users, or "Hackers" of the service.
WEBTIME INTERNET TOOLS is not responsible for the procurement of substitute goods or services.

Indemnification. Upon WEBTIME INTERNET TOOLS request, you shall defend, indemnify and hold harmless WEBTIME INTERNET TOOLS, its affiliated companies, officers, directors, employees, agents and licensees, from any claims, losses, damages, expenses, and fees including without limitation reasonable solicitors fees, arising out of or relating to:
I. Development, operation or maintenance or Your Account.
II. Your use of and enrollment in the service, including without limitation any violation of this agreement.

Amendment. WEBTIME INTERNET TOOLS reserves the right to modify the WEBMASTER AGREEMENT at their sole discretion and without prior notice. It is your responsibility to keep current with changes in the agreement, since changes are effective for all WEBMASTERS. Any modification is effective immediately and can be accessed at the WEBMASTER AGREEMENT page, currently located at: http://www.WEBTIME INTERNET TOOLS.com If any modification to this Agreement is unacceptable to you, you may immediately cancel your WEBMASTER Registration. However, if you continue to use the service following any modification to this Agreement, your continued use will mean that you have accepted any modification.
